Using the ESA to guide our land and water use direction has always been controversial, and many more so in the San Joaquin valley where one time Congressman Richard Pombo turned it into an almost daily mantra. Fortunately some organizations like CBD and the Sierra Club have learned to use it only where truly required. Still, it is under considerable attack and seems destined to be an issue in the CA Gubernatorial race where Meg Whitman has spoken loudly and often about turning on the water for farmers... the action that brought about the CBD suit. Then, she donates big bucks to the Environmental Defense Fund. Sound like she does not really want to commit to anything.
