Water rights suit against Calistoga broadens; Reynolds draws Fish and Game into suit against City for swiping water

“A San Diego man filing suit against the City of Calistoga for allegedly swiping water it had no right to has hauled the Department of Fish & Game (DFG) into the fray.
The move, made in a writ of mandate filed in Napa Superior Court on Friday (Jan. 15, 2010) essentially sidesteps an apparent attempt by the City of Calistoga attorneys to prevent Reynolds from holding the city to blame for damages to the environment and forcing a state water control board to goad the city into correcting the damage in the fifth cause of action in Reynold’s suit, Reynolds said late Friday.
In a previous motion filed by the City, city attorneys alleged Reynolds was the one trying to do the sidestepping, essentially asking the court to assume authority of the state to “maintain an adequate flow of water sufficient to restore and sustain the fisher that has been destroyed and will continue to be irreparably harmed if a minimum natural flow of water is not derived from the springs hidden by the waters of it reservoir…” . … “
